Mediation Profile

I am a partner in the Chicago office of Duane Morris, LLP. I concentrate my practice in the area of construction law, litigation, and alternate dispute resolution. I represent general contractors, construction managers, owners, architects and engineers, design builders, and subcontractors in matters involving contract drafting, contract negotiation, breach of contract claims, claims for extras, delay, disruption, loss of productivity, excessive change orders, out-of-scope work, and claims involving mechanic's liens. 

I am a mediator and Arbitrator for the American Arbitration Association and the International Centre for Dispute Resolution, and have acted as a mediator in over 350 construction disputes. These mediations have included disputes that arise out of the construction of power plants, waste water treatment plants, airports, theme parks, bridges, highways, hospitals, hotels, schools, churches, high-rise condominiums, and office buildings. I have also acted as a mediator in general commercial disputes, and will and probate disputes. The vast majority of cases I have mediated have involved three or more parties with several mediations involving as many as ten parties and lasting multiple days. 

I am also a mediator for the Circuit Court of Cook County, Court Annexed Major Civil Case Mediation Program. I have written numerous articles on alternate dispute resolution, and have been chosen as a Tier 1 lawyer in Chambers USA; America's Leading Lawyers for Business, one of only six lawyers in the State of Illinois to be so chosen. I am also listed in Best Lawyers of America and have been named a "Superlawyer" by Chicago Magazine and Law and Politics. I have lectured extensively on construction related matters, including claim prevention, claim prosecution, and contract terms that materially affect risk allocation between the parties.

I have successfully mediated hundreds of complex construction disputes and numerous commercial disputes over the last 15 years, including primarily construction, general commercial, and will and probate.

I believe that parties trust me to mediate their case because of my background and experience in both construction law and as a trial lawyer. While the role of a mediator is to bring the parties together in a settlement, my success as a mediator rests in large part on asking each of the parties the tough questions as they relate to the substance of their positions, and the evidence that will be introduced at trial or in arbitration. I provide each of the parties with an honest evaluation of his or her case, both positive and negative aspects. If the party has a strong position, I do not mislead the party into thinking otherwise. This mediation philosophy allows me to settle approximately 90% of the cases that I mediate.
