Mediation Profile

I qualified as a solicitor in 1979 and as a mediator in 1991 and since then I have been actively involved not only in practicing as a commercial mediator but also in the development of mediation practice in the UK. Until 2012 I combined that practice with my own practice as a solicitor specialising in commercial litigation.

I was described in The Legal 500 (2011) as one of the best solicitors, he has an extraordinary grasp of facts and a remarkable analytical
mind and knowledge of the law.

I was Senior Partner of the Oxford law firm (Linnells) from 1998, leading it into a merger with the larger regional firm of Blake Lapthorn in 2003. I was Chairman of Blake Lapthorn from 2005 until 2011 and left the firm in 2012. During my time as Senior Partner and Chairman I acquired wide experience of partnership matters and the challenges of running a business, which means i understand, probably to a greater degree than many legal advisors because of my personal experience, the need for practical and commercial solutions to problems.

I joined Independent Mediators in 2012.

I have been a commercial mediator for 24 years and since early 2012 have mediated full time. My mediation practice has covered a wide variety of areas but in particular I have considerable knowledge of professional negligence disputes, construction disputes, property disputes (particularly those arising out of disputed wills and probate), partnership, employment, financial services, as well as more general commercial, company and contractual matters.

Other Dispute Resolution Experience:
• Certified by the International Mediation Institute
• Distinguished Fellow of the International Academy of Mediators
• Member of the Advisory Board of the Standing Committee of Mediation Advocates
• Director and subsequently Chairman of ADR Net Limited until 2011
• Member of the Court of Appeal's Mediation Panel
• I speak regularly on mediation topics both in the UK and abroad
• I also provide training courses in preparation and presentation at mediations

I am willing to adopt an evaluative approach to mediations. Whilst recognising I am not there to determine the issues, I am happy to engage with the parties on the strengths and weaknesses of their claims. My experience as a commercial lawyer and litigator of over 30 years, and a mediator for more than 20 years, has given me a good insight into the realities of dispute resolution. I believe that settlements tend to emerge as a consequence of the parties taking a realistic look at the prospects of success or failure of the whole or aspects of their case and then taking a similar approach when looking at the case of their opponents. In addition I look to give the parties an opportunity to consider options other than simple win or lose. Whilst many disputes are primarily claims about money, there are often other issues that need to be addressed before a constructive discussion about financial settlement can take place. However, at the end of the day, I recognise I am there to help the parties achieve their settlement of the dispute that they have brought to mediation and I work with them to achieve the settlement they want.
