He is a member of the American Arbitration Association's National Roster of Neutrals serving on its panel of Mediators and as an Arbitrator on its large, complex case panel, and its commercial and construction panels. As an arbitrator, he is often as Chair of three member panels, on cases involving a wide variety of complex design, construction and real estate issues. This experiences give him the understanding of the issues and credibility as a mediator. 

He has more than 40 years experience as an attorney concentrating in the construction industry representing owners, developers, contractors, trade contractors, lenders, architects and engineers in disputes and contract negotiations. Disputes have involved trial courts, appellate courts and arbitration forums where he was lead counsel.

Over 20 years of experience as a mediator in complex construction matters, including multi-party disputes.

I investigate why the parties are at an impasse prior to the commencement of a formal mediation. These factors need to part of the design of the mediation process and may include personalities, risk profiles, lack of attention by stakeholders to risks, disputes among experts, role of counsel, anger, insurance coverage issues, etc. I investigate through confidential conversations with counsel for each of the parties and by review of important documents. I encourage the lawyers to educate clients as to expectations of what will likely happen at the mediation. I also make sure that the true stakeholders are participating in the mediation process. Insurers require special handling to deal with their evaluations and the way they want to participate in the mediation process. I prefer to do mediation as early as possible in the history of the dispute. However, cases cannot settle unless the parties have knowledge of the important facts. I facilitate the exchange of this information as efficiently as possible. Most of my meditations are settled within one day, though the day may be long. I do not like to send parties home if we are making progress. The most difficult task that mediators face is to confront and resolve impasse. My skills in overcoming impasse include an optimistic personality, hard work and an ability to make participants understand their options to settlement. The fact that I have 40 years experience as a well-regarded construction lawyer give me credibility on that options issue. I also am a creative person and often will problem solve by thinking “outside the box.” In those few cases that I do not settle during the formal mediation process, I am told that what was learned in the mediation was important in the eventual settlement. I believe that parties settle only based on terms that they considered to be fair. Therefore, I spend a lot of time educating the parties as to fairness.
