Settlement Facilitation/Evaluative The Settlement Facilitator, Retired Judge Steven I. Platt, will draw upon his quarter-century of experience as a trial judge, his formal training as a Mediator, and his experience with facilitating thousands of Settlement Conferences in complex cases as a lawyer and a judge for over 25 years, to become a facilitator for the parties to reach an agreement. The methods involved in resolving the dispute may include Mediation, Neutral Case Evaluation and Neutral Fact-finding. Ultimately, Judge Platt may recommend the terms of an agreement. Settlement Facilitation is his predominant style and he is primarialy an evaluative mediator who utilizes techniques from other styles of mediation when they can be employed effectively. Neutral Case Evaluation The parties through their attorneys present arguments and evidence supporting their respective position in summary fashion to Judge Platt . He then renders an evaluation of their positions and an opinion as to the likely outcome of the dispute or issue if the action was to be tried. Neutral Fact-Finding The parties and their attorneys present arguments and evidence supporting their respective positions as to particular disputed factual issues to Retired Judge Steven I. Platt. Judge Platt acting as a neutral fact-finder then makes findings of fact as to those issues. Unless the parties otherwise agree in writing, those findings are not binding.
