Kazakhstan Ratifies the Singapore Convention

With the deposit of the instrument of ratification, Kazakhstan becomes the 10th State Party to the United Nations Convention on International Settlement Agreements Resulting from Mediation, also known as the “Singapore Convention on Mediation”, which now has 55 signatories.

The ratification by Kazakhstan was effected on 23 May 2022 and the Convention will enter into force for Kazakhstan on 23 November 2022.

Kazakhstan has made two reservations upon ratification of the Singapore Convention on Mediation: 

“1. In accordance with article 8, paragraph 1 (a) of the Convention, the Republic of Kazakhstan does not apply this Convention to settlement agreements to which it is a party, or to which any governmental agencies or any person acting on behalf of a governmental agency is a party.

2. In accordance with article 8, paragraph 1 (b) of the Convention, the Republic of Kazakhstan shall apply this Convention only to the extent that the parties to the settlement agreement have agreed to the application of the Convention.”

The Singapore Convention on Mediation facilitates international trade and promotes mediation as an alternative and effective method of resolving commercial disputes by providing an effective mechanism for the enforcement of international settlement agreements resulting from mediation.

The Convention is open for signature, ratification, and accession by States and regional economic integration organizations.
