Mediation Profile

Barrister, Accredited Mediator (CEDR - 1997) and Chartered Arbitrator in practice at  6 Pump Court, Temple, London EC4Y 7AR, United Kingdom. He has been actively involved in ADR – in particular mediation - for some 10 years. Has acted as Mediator / Conciliator in over 50 cases. His experience in mediation arises out of a background of dispute resolution practice at the English Bar since 1975 (he has appeared in lengthy and complex court cases in most English courts, including the High Court and Court of Appeal) and of practice as an arbitrator - and counsel - in national and international arbitrations. His experience as mediator (and counsel) in both domestic and high – value international commercial mediations includes acting as mediator and counsel in international commercial mediations in England (counsel in international metals arbitration where parties agreed to mediate during the course of the arbitration); in Beijing (counsel in ICC arbitration where arbitrator at a hearing in Beijing agreed to switch to act as mediator); and in Singapore (sole mediator in 3 - day mediation in complex oil-related dispute). This background experience as counsel, arbitrator and mediator gives him a broad understating of the dispute resolution process in the most complex of multi-million U.S. dollar commercial disputes - both in the national and international arena. Experience in both domestic (English) and international commercial mediation - and in arbitration and other forms of international dispute resolution: International mediation (and arbitration) cases have covered various types of commercial disputes including contracts for the sale and carriage of goods; letters of credit; international metals contracts; oil contracts; oil drilling jack up rig contracts; joint venture agreements; franchising; trade marks; know-how licensing; armaments and weapons systems; hotels; fashion and clothing manufacturing contracts. These examples include complex commercial disputes involving claims for millions of U.S. dollars. Appointed in various cases by the ICC’ s International Centre for Expertise, Paris. Appointed by the UN’s World Intellectual Property Organisation, Geneva, as panellist in WIPO domain name disputes.

A primarily facilitative and evaluative style aimed at problem-solving: an approach used in conjunction with a clear understanding of the dispute in question derived from the pre-mediation documentaion and pre-mediation meetings, together with information obtained in the general and caucus sessions with the parties and their represenatives at the mediation itself. This approach to mediation is used against a background of considerable experience of complex commercial disputes gained as a barrister in the English courts, as counsel in arbitrations and mediations, and as arbitrator and mediator - in disputes running into hundreds of millions of U.S. dollars. The facilitative/evaluative/problem-solving style has been adopted in both domestic and international mediations: international mediations both as counsel and mediator in complex commercial disputes in various parts of the world.
