Mediation Profile

As a mediator and peacemaker, Mr. Noll has worked on over 1,200 conflicts, both litigated and non-litigated. Mr. Noll specializes in difficult, complex and intractable conflicts where relationships are involved. Mr. Noll is also a senior consultant and principal in Boogaert & Noll, LLC and provides leadership development, problem-solving, crisis management, and conflict transformation services to clients. Mr. Noll is also a senior consultant with Mobius Executive Leadership, which provides transformative leadership development to its clients. Mr. Noll is an author (see below) and host of the Internet radio show, The Doug Noll Show. He is an adjunct professor of law at San Joaquin College of Law, Clovis California, and an active keynote speaker, presenter, teacher and trainer.

In addition to the types of matters discussed above, Mr. Noll has mediated over 150 criminal cases between victims and offenders. Mr. Noll has been a full time mediator since 2000 and conducted his first mediation in 1981. AAA panelist since 1981. Mr. Noll does not subscribe to a style of mediation, believing that the dispute will determine the process most efficient and beneficial to the parties. As a general rule, Mr. Noll will use caucuses in non-relational cases and prefers longer joint sessions when relationships are at issue. He is skillled and comfortable with intense emotional conflicts.

Partnership and Family Business: Mr. Noll has mediated hundreds of family and small business conflicts and partnership disputes, including a 60 day mediation involving the break up of a $500 million real estate partnership. Land and Real Property: Mr. Noll has mediated easements, rights of way, land use development, mining and oil and gas rights, and similar disputes. Construction: Mr. Noll has mediated construction disputes of all kinds, including public and private works, industrial, commercial, and residential construction defects. Commercial: Mr. Noll has mediate a wide variety of commercial disputes, both litigated and non-litigated involving intellectual property, patent infringement, breach of contract, Uniform Commercial Code, finance, banking, credit restructuring, general insolvency, bankruptcy (including adversary proceedings) and general business disputes. Employment: Mr. Noll has mediated employment cases involving both terminated and continuing employees, employee groups, and disabled employees and including a wide varieity of companies, claims, and circumstances. Agriculture: Mr. Noll has mediated disputes involving crop losses, cold storage claims, processing and production claims, grower-processor disputes (particularly in the California wine industry), commission merchant claims, transportation and distribution disputes, and ancillary products and services disputes (e.g., irrigation design and installation, farm equipment purchase and repair, etc.) Water and Environment: Mr. Noll has mediated water rights disputes over surface, riparian, ground water, and pollution claims. Mr. Noll has mediated environmental disputes involving water, hazardous waste, and toxic substances. Mr. Noll has been engaged to design, implement, manage, and close a public dialogue process around the expansion of a hazardous waste facility. Religious: Mr Noll has mediated clergy sexual abuse cases, congregational disputes, and church schisms.
