Mediation Profile

Jane Player is a mediator in both domestic and international commercial disputes. Jane combines regular mediator work with her role as Dispute Partner at the international law firm, King & Spalding International LLP. Jane qualified as a mediator in 2001 with CEDR and has mediated hundreds of disputes in her career to date. 

The profile of Jane's cases in mediation are at their essence business trade disputes to include breach of contract, termination of agreements, joint venture collapses or shareholder disputes arising out of a number of key industry sectors. Jane has particular expertise in cross border negotiation and mediation and has been involved in a number of multi party/multi cultural mediations in the last two years. Jane enjoys the challenge of encouraging parties with strong personalities to try the process where there might be some cynicism towards the potential for dispute resolution through mediation, and Jane tries to create a flexible process to meet those client's needs. 

Jane is a member of the faculty of CEDR, on the panel of IPOS and a chair of the mediation sub-committee at the IBA.

Jane has mediated regularly over the last eleven years and has equally had regular experience as a lawyer advising clients within a mediation context and is therefore able to see the important role that parties’ advisers plays in bringing a dispute to a successful conclusion, through mediation. Jane’s experience is mainly in the business commercial arena although there have been some individual claims where, for example, franchisees have taken issue with large global companies. The range of recent international mediation experience includes disputes with parties from jurisdictions such as Korea, Turkey, Hungary, Spain, CIS, America, Middle East and the UK and includes the participation of third party interests such as insurers and funders.

Jane is very proactive at guiding clients through the process and getting the best value out of the use of a mediator. The fact she is a mediator herself helps her work well both with the Mediator on the clients' behalf, but also with the clients, especially those less familiar with the process. Jane has extensive experience of acting for clients in various jurisdictions where perhaps mediation is less well known and can help mould the process to best fit the cross cultural needs of the parties. She is conscious of the need as a mediation advocate to allow the mediation to empower the principals to reach the solution themselves and that the role of the advocate is to support that dynamically, and be as creative as possible in exploring all options, with the clients, for an ultimate resolution.

Jane has a sliding scale for fees depending on the amount at stake but as at 2012 a typical fee for an 8 hour mediation to include 5 hours preparation is between £3,500 to £5,000 per day.

Training and Education

Jane is an active member of a number of mediation service providers and a member of the training faculty for CEDR. Jane regularly reads around her subject and is constantly honing her own skills as well as passing those skills down to more junior mediators starting off on their careers. Jane’s involvement with the mediation section of the IBA over the last 6 years has enabled her to stay at the top of her game in recognising international trends in mediation, and responding to them. Jane has also been involved in mediation training for in-house lawyers within client organisations as a means of improving their negotiations skills. Jane has developed and prepared her own training for mediation as well as cross cultural relationship training for clients and lawyers alike throughout the Bird & Bird and now King & Spalding network.

Jane is a solicitor with the law Society of England and Wales, so has a professional code, and she also abides by the Mediator's code of professional conduct endorsed by CEDR.

Complaints can be brought to CEDR or IPOS if appointed through those organisations. Further, if appointed direct through King & Spalding LLP there is a formal complaints process internally for all partners. The IMI Professional Conduct Assessment process is also available.

Jane carries professional liability insurance as a partner of King & Spalding International LLP and this covers her work as a mediation Advocate.
