Why Private International Law Matters in Mediation Practice

When a mediation crosses borders, underlying legal frameworks are often overlooked. However, they shape the process and ask vital questions of the parties: Where should the mediation take place? What rules will govern it? What happens if a settlement agreement needs to be enforced? These are not abstract legal questions, they have real, practical consequences for how mediations are initiated, conducted, and enforced. As international mediation practice grows and legislative frameworks continue to evolve, understanding these issues is becoming an increasingly important part of professional competence.

About the Book: The Private International Law of Commercial Mediation

Dr. Meidanis’ book will form the backbone of the webinar. While mediation is primarily a non-legal process, the law is always present as a “shell” around it. From the agreement or court order that sets it in motion, through the rules governing the process, to the law applicable to the resulting settlement agreement. The book examines this legal shell across three core pillars: venue, applicable law, and enforcement, set against the broader background of how the international community is approaching mediation.

Rather than a formal book presentation, the webinar will use this framework as a basis for substantive practitioner debate, keeping the discussion grounded in what these legal realities mean in practice for mediators and parties.

We hope to see you online!
