It was an incredibly enriching experience to virtually attend the EUIPO’s IP Mediation Conference 2025 held on 16th and 17th of October in Malta. It covered highly interactive and thought-provoking deliberations on a wide range of topics, including how to galvanise the lawyer and client into a true tandem team, judicial leadership in IP disputes, and wisely as well as widely using the latest technology artificial intelligence or AI in mediation. It was heartening to hear some of the speakers stress the need for the EU to sign and ratify the Singapore Convention on Mediation so that the EU members could fully benefit from the process of mediation. Climax of the EUIPO’s IP Mediation Conference 2025 was to watch a role-play based simulated or mock mediation in which the opening stage, exploration and bargaining phase of the mediation and eventually conclusion of the mediation process with a mediated settlement agreement were skilfully demonstrated. It was about a trademark dispute between two French and German companies. Although, both the parties were initially reluctant, apprehensive and frustrated, the third party neutral i.e. mediator deftly managed the process so that the two rival sides could rethink their rigid positions, identify their underlying interests, and move towards a mutually acceptable settlement agreement. Empathetic listening, paraphrasing, summarising, equal treatment of parties, reiterating confidentiality at various stages of hearing, conveying views of one party to the other one only with their prior express consent were elucidated by the mediator. Joint sessions as well as separate private sessions or caucuses were held by the mediator with both the parties with their consent. They were told about the features of the mediation process such as voluntary, confidential and impartial before the actual commencement of the proceedings. At last, when the mediated settlement agreement was arrived at, the disputants heaved a sigh of relief and appreciated the worth of mediation mechanism.
