Mediation Profile

Bette Roth has over 40 years of combined experience as a mediator, arbitrator, and lawyer. She has served as mediator in approximately 1600 cases involving a wide range of commercial, employment, securities, real estate, construction, and professional liability issues. She is a member of the AAA Panel of Mediators (designated "master mediator"), AAA's Panels of Commercial and Employment Arbitrators, Boston's Real Estate Bar Association (REBA) Panel of Neutrals. She taught the mediation course at Boston University School of Law for over a decade. Prior to focusing her practice exclusively on disputes resolution in 1992, Ms. Roth litigated with San Francisco law firms, following service as an enforcement attorney with the U.S. Securities and Exchange Commission.

Approximately 1,600 mediations and 400 arbitrations involving, among other things, employment discrimination, wage/hour disputes, commercial and partnership contract disputes, security/banking disputes, construction disputes, claims involving class, fiduciary, and equitable issues.

"I combine the facilitative and evaluative approaches to mediation. I listen to parties to help them explore their interests in resolution. Drawing from my years of experience as an attorney and arbitrator, I help parties to assess risk based on the case strengths and weaknesses, consider possible outcomes, evaluate and fashion proposals, and move toward settlement. I believe that every case can be settled with hard work and an open mind. I expect counsel to prepare for the mediation by exploring with their clients a range of settlement options in light of the facts of the facts of their case and the applicable law. I ask counsel to submit materials in advance (mediation statements, pleadings, motions, and damage/expert reports where applicable) and I always review them thoroughly before the mediation session. I make myself available for questions or assistance before the mediation session. Approximately 95% of my mediations conclude with a settlement within 5-8 hours. If the case is not able to conclude during the scheduled time, I follow up with counsel (typically by telephone) until the matter is resolved."

Employment: discrimination, wrongful termination, wage/hour, non-compete, executive contracts/severance. Commercial: contracts, partnerships, banking, franchise, UCC, bankruptcy; closely held corporations, leases. Securities: individual, partnership, trust, ERISA, and pensions involving registered representatives, broker-dealers, banks, accounting firms, transfer agents. Real  estate: land use, ownership, real estate sales, zoning, title, adverse possession, environmental, housing discrimination. Construction: commercial, residential, and municipal involving claims and counterclaims by owner, general and subcontractors, engineers, architects, and bonding companies. Professional liability: negligence, breach of fiduciary duty, negligent supervision, malpractice, fraud.

$600/hour plus travel expenses for session, study, and preparation time. Travel time invoiced at reduced rate. Cancellation notice to avoid fee for time reserved.

Ms. Roth speaks frequently on mediation and arbitration at various CLE and Bar Association programs on mediation and arbitration involving cases relating to employment, closely held corporations, securities, class actions, ethics, confidentiality, enforceability of settlement agreements.
