This Feedback Digest is based on 5 feedbacks in 5 mediations over the 2-year period August 2007-August 2009. Stephen Bate is a commercial mediator and practising barrister based in London. His feedback reflects a man with a keen sense of negotiation strategies who shows “a real interest” in every case and in “helping the parties to achieve resolution”. With clients repeatedly impressed by his thorough preparation and his easy grasp of the legal and commercial dynamics of conflict, he has received consistently excellent feedback over the last 2 years. Demonstrating a keen interest in each case, he is able to build rapport with all participants so quickly and with such ease that they do not feel at all uncomfortable if and when he tests their positions and/or expectations. All parties noted that Stephen took the time to learn about their case and they were very confident in his ability to put their views and points to the other side. His ability to remain entirely balanced throughout the process and assist the parties in working through complex legal and factual issues to focus on settlements, appears to be a key strength. Aware of the impact of the mediation process on the parties, particularly during the private meetings, Stephen is evidently excellent at ensuring all are well informed about progress and updated regularly. “Not pushy” but “firm when required”, Stephen has a “measured, sensible and helpful” approach, resulting in the parties stating clearly that they would not hesitate to use him again. A pragmatic, focussed mediator, Stephen demonstrates easily that whereas he is “interested in assisting both parties in getting the best deal”, settlement does not come “at any cost”. No negative feedback was reviewed over the preceding 2-year period.
