Mediation Profile

I have  completed my primary law degree (B.A.-LL.B.) in June 2018. Whilst in law school, I was involved in different moot courts and debate competition. This included my participation in the National Moot Court and Debating Competition, where I was awarded the first prize for best research memorial, being the legal researcher. This involvement fostered my interest in dispute resolution.  I took to writing articles. One of which dealt with the possibility and feasibility of integrating mediation in cases involving young offenders (please see at https://www.livelaw.in/integration-mediation-cases-involving-young-offenders/).  
At Cornell Law School,  I took  the following courses, among others, in  International Commercial Arbitration, Negotiation in Business and Sports, International Investment Law and Business Organization.  Having taken all these classes, together with participation in extra-curricular activities such as the Campus Mediation Practicum and International Arbitration Society, have increased my  knowledge and interest for dispute resolution and commercial litigation.
Mediation is one of the more efficient techniques of Alternate Dispute Resolution, it provides the a better blend of formal and informal procedure.

Background: 

I was selected to  work as a Mediator with the prestigious Scheinman Institute of Conflict Resolution at Cornell University (September 2018-April 2019). Further, I have had the opportunity to work at numerous law firms, Government Departments, Office of Judges, and with Advocates in New Delhi in a wide range of matters where I have had the opportunity to attend a few mediation proceedings.. I had the responsibility of reviewing documents, drafting pleadings and other written submissions and doing research on different matters.  I also worked as a para-legal volunteer with the Delhi State Legal Services Authority, where I had the chance of participating in the organization of Lok Adalats (People's Courts), a mechanism for providing quick justice to people, and learn techniques for alternative dispute resolution employed by the Indian judiciary to reduce the immense backlog of cases.  I was awarded a scholarship, funded by the Shanghainese Government, to attend a summer school on Chinese Laws which focused on Chinese family laws and labor laws. I was also awarded for my presentation on a comparative study of the marriage law of India, China, and Indonesia.

Course Name:  Campus Mediation Practicum Fall Semester.

Duration: 40+ hours, August 2018- December 2018.

Mentor: Professor R. Scanza and Professor Katrina Nobles 

Prerequisite- CORNELL ILR 6080 / LAW 6080 FALL 2017 LAW 6080 Advanced Issues in ADR - Mediation: Theory and Practice. The prerequisite was waived by the Professor after reviewing my profile at my request.

Description: This course is offered to students interested in acquiring the knowledge, skills and techniques necessary to mediate interpersonal disputes. In the first segment of the course, students will be introduced to the guiding principles of interpersonal mediation. A review of the theories of conflict, its roots and its resolution, set the stage for the role mediation can effectively play in resolving conflict. Students are introduced to the models of mediation and the benefits and challenges of each, including a comparative analysis of evaluative, facilitative and transformative styles of mediation. In the second segment, students will be assigned to mediate cases referred to the Scheinman Institute from the Office of the Judicial Administrator. The role of gender, race, culture, ethics and impasse in mediation will all be examined and incorporated into workshops and case studies. Students will have several opportunities to apply their knowledge of mediation and acquire the skills necessary to become effective mediators. Following each case assignment, students will be required to write a paper analyzing the nature of the complaint, the approach and techniques employed during the case and the student’s evaluation of what worked and did not work in their attempt to resolve the conflict. Oversight will be provided by the course instructors.

During the course, I worked as a student mediator. I continued working as a student mediator in Spring Semester, along with taking cases I was involved in mentoring students who took the course in the Spring Semester.
