Parties and counsel who have used Mr. Rubin would overwhelmingly use his services again and would, without hesitation, recommend him to others. Typical of the comments reflecting Mr. Rubin’s acceptability are: (i) He successfully mediated a complex and emotionally charged dispute and navigated the array of personalities while maintaining the attention and the respect of both sides throughout; (ii) Mr. Rubin came highly recommended as the mediator for this action, and he certainly lived up to his billing; and (iii) In all, I have used Bob twice as a mediator and was very happy on both occasions. He understood the issues and could pointedly discuss each party’s strengths and weaknesses. Mr. Rubin’s mediation skills and abilities are rated as highly effective. Typical of feedback received in this regard are: (i) Demonstrated an immediate and thorough grasp of the relevant issues and worked hard (and long) to assist the parties in reaching a resolution; (ii) He remained focused (and kept the parties focused) on the key issues necessary to reach a resolution; (iii) He masters and communicates complex issues and strengths and weakness of all sides. He understands and encourages the participants’ needs to express why they feel wronged while helping them understand the practical benefits in moving forward with a settlement. He has an incredibly even-keeled approach and an uncanny understanding of the actual (as opposed to the articulated) desires and limits of the parties; (iv) Mr. Rubin’s ability to listen and to distill complicated issues down to easy to understand and negotiable components were clearly instrumental in making a difference in this particular mediation; and (v) Bob not only possesses a wealth of technical experience, his ability to deal with varying personalities and explain the benefits of compromise make him an excellent mediator. Mr. Rubin is also highly regarded for his ability to effect a positive outcome. For example, one provider of feedback noted that he fostered a cooperative, less adversarial and, thus, more productive atmosphere. Another noted that Mr. Rubin was extremely effective at taking two relatively recalcitrant parties through a mediation process that produced a constructive, mutually beneficially settlement proposal. Costs were widely reported as reasonable in the context of the value of the disputes mediated by Mr. Rubin, and in general a very high degree of satisfaction was reported. No reportable negative comments have been received since Mr. Rubin’s designation as an IMI Certified Mediator.
