IMI Announces Joint Conference at UN WGII

by UNCITRAL, the Vienna International Arbitration Centre (VIAC) and the International Mediation Institute (IMI) as a side event on mediation at the occasion of the forthcoming session of the UNCITRAL Working Group on Arbitration and Conciliation. Participation is free of charge.

Questions relating to settlement agreements resulting from mediation will be addressed in 2 Panel sessions.

International vs. Domestic Mediation – Security vs. Flexibility

  1. What are the characteristics of international mediation as opposed to domestic mediation? How are those characteristics relevant to the design of a cross-border enforcement instrument for mediated settlement agreements ?
  1. Why is there a need for a specific instrument on cross-border enforcement of settlement agreements?
  1. How to reconcile the flexible nature of international mediation with formal requirements of enforcement procedure ?
