Mr Danny McFadden has consistently been rated at the highest level by lawyers and parties for whom he has acted as a mediator. He achieved outstanding approval levels and this has led to his being appointed by parties on a repeat basis. All respondents indicate that they are highly likely to appoint Danny as a mediator again, and that they would certainly recommend him as a mediator to others. The feedback shows that his style is that of a flexible commercial mediator, who takes a positive, constructive approach but it also shows he is not afraid to test the parties robustly in relation to their positions and is highly pragmatic when assisting parties to consider possible solutions. His experience in international business was noted and the fact that it allows him to adopt a problem solving approach which tries to find real world solutions to sometimes difficult disputes. “Very hard working, persuasive and professional”. His cross cultural expertise and ability to work with parties from many different cultures both in negotiation and mediation was noted by respondents as a key strength. Being able to speak Chinese Mandarin fluently when needed was also seen as an asset in the Asian context. “Wealth of experience both in mediation and cross culturally”. It was noted by respondents that Danny is a firm believer in thorough preparation and the importance of pre-mediation contact with both sides.The feedback reports show that Danny gains the parties’ confidence in him by demonstrating a sound knowledge of the dispute in question with a grasp of both the commercial, cultural and legal background of the case. He creates early rapport with the parties, building on this to shift focus during the mediation towards the problem as a shared obstacle, one which can only be resolved through good communication between both sides assisted when needed by the mediator. Danny received positive feedback from his World Bank cases and it appears clear he is particularly good in all types of employment cases being seen as calm and patient with just the right degree of firmness when needed. His ability to mediate large scale workplace collective bargaining cases was noted; especially those needing the organisational skills required in dealing with multiple stakeholders. Being involved as a full time mediation professional for over 10 years it is apparent Danny has the ability to mediate a wide range of subject areas and he received feedback from diverse sectors of commerce, industry, construction and employment cases. He was reported as being able to handle complex cases whilst encouraging the parties to create resolution opportunities within seemingly intractable disputes. He achieved a high resolution rate across many sectors and even when cases did not settle respondents reported they were very satisfied with his work as the mediator. Danny always follows up after unresolved cases and often those types of cases went on to reach resolution after the mediation proper had ended. Participants reported that he has an attitude of “never say die” and is very persistent in trying to assist parties work through deadlock and find resolution. “Persistent, wouldn’t allow parties to give up”. He was praised for being a calming influence “Efficient and patient” and for being able to handle sometimes highly emotional situations. Danny is regarded as being friendly and relaxed but when occasion demanded it being able to assert his role as manager of the process even when faced by strong personalities or uncooperative legal advisers. He was consistently regarded as a good listener and someone who has a keen understanding of cultural nuances. Overall the feedback demonstrates he is able to use a wide range of flexible mediation skills which are capable of being adapted to the needs of the parties and the type of dispute.
