Feedback digest by AAA-ICDR, 10 Jul 2018 This Feedback Digest has been updated to include 5 Feedbacks in 10 or more Mediations as of May 12, 2009. Parties and counsel who have used Mr. Fieldsteel would overwhelmingly use his services again and would, without hesitation, recommend him to others. Typical of the comments reflecting Mr. Fieldsteel’s acceptability are: (i) Mr. Fieldsteel had an excellent understanding of the issues of importance to the parties, kept the parties focused on resolving disputed points but let the parties raise and discuss grievances that did not directly involve the disputed issues but impacted the parties comfort with one another and the mediation process; (ii) He is smart, effective and credible. He knows the subject matter; (iii) John is highly respected in the Boston legal community and frequently mentioned as among the very best. He is always at the top of my list for alternate dispute resolution; and (iv) Attorney Fieldsteel is one of the best mediators I have been before in areas of construction law. I do not think that there is anyone better in Boston. I have had the pleasure of working with Attorney Fieldsteel on quite a few cases. I have always found his approach to cases unique and excellent. I had also found that he brings special skills to the table in multiple party cases where there are special requirements for any good mediator. Mr. Fieldsteel’s mediation skills and abilities are rated as highly effective. Typical of feedback received in this regard are: (i) Mr. Fieldsteel had the ability to assess the flexibility of the positions of each of the parties, which allowed the mediation to move forward and not stall; (ii) He has good a demeanor, communication skills, practicality and comprehension of legal claims and defenses; (iii) John was able to break through an impasse among the parties that had up to that point seemed immovable. I credit John’s skill and experience for this achievement; and (iv) John brings special skills to the table in mediation. I have worked with him on two party cases and I have worked with him on multiple party cases. The most recent mediation probably had forty people involved. There were construction issues and there were insurance issues on the completed operation hazard of CGL policies. I think the special skills that he brings to the table are his understanding of both construction issues and of insurance issues on the completed operation hazards. He has the ability to listen and to make people comfortable with his approach. Mr. Fieldsteel is also highly regarded for his ability to effect a positive outcome. For example, one provider of feedback noted that as a result of the way the mediation was handled, the parties resolved the issue being mediated and left the process with a strong likelihood of doing business together in the future. While another noted that John’s approach is very matter-of-fact and practical, and believes his skills were essential to the positive outcome in both mediations. Costs were widely reported as reasonable in the context of the value of the disputes mediated by Mr. Fieldsteel, and in general a very high degree of satisfaction was reported. No reportable negative comments have been received since Mr. Fieldsteel’s designation as an IMI Certified Mediator.
