This Feedback Digest is based in more than 22 feedback forms, initially collected in 2004. Mark Lomas has consistently been rated at Performance Level 5 by the parties for whom he has acted as a mediator, and without exception the solicitors and clients who have appointed Mark have expressed their pleasure and confirmed they would be very happy to use him again. The following is a summary of the feedback given by clients when referring to his performance: Mark is considered to be very thoroughly prepared even in cases where papers have been delivered only a short time prior to the mediation. He is recognised as having a very strong grasp of the issues involved, which has helped to develop trust early in many mediations. Clients regularly comment on his grasp of the facts and issues and his strong legal background and experience. He wears his legal knowledge lightly and does not overbear clients. He is able to achieve settlement in cases where other mediators may not be able to do so. Clients have commented that his preparation is second to none and his grasp of the issues is immediate and immaculate. Mark’s formidable legal acumen and his expert handling means he is highly recommended for complex and technical disputes and is tireless and robust in pursuing what might appear to be a lost cause. He is considered adept at handling multiparty claims where he is said to “cut through the noise”. Lay clients have been particularly impressed with Mark’s ability to test the strengths and weaknesses not only of their case but also the other side’s case and the risks entailed. This has given them the opportunity to gain clarity of the issues from the perspective of both sides which has hastened settlement. Respondents have commented on Marks’ delightful calm manner, which enables him to quickly gain the trust and confidence of the parties, putting them at their ease, which has assisted them to concentrate on the issues and move forward. They felt that Mark’s easy manner encourages frankness and openness and also brings his sense of humour to bear. He is said to understand, and therefore assist the parties, in seeing their way through complex and difficult situations. Although numerous clients have commented on how courteously and charmingly Mark handles the mediation and the attendees they note that he has an “Iron fist in a velvet glove.”, being willing to strongly challenge both clients and solicitors if he feels it is necessary to assist in gaining a settlement. Respondents consider that Mark is friendly and has excellent rapport with those attending mediation who trust his judgment and opinion which, while it may be given forcefully, is always done is a friendly and helpful manner. In summary he is regularly referred to as; “brilliant” “excellent” “first class” and “to have achieved the impossible in mediations.” To date we have received no negative feedback.
