This Feedback Digest is based on seven feedbacks in seven mediations and an article from Daily Journal initially submitted on May 13, 2009. Overall, Mr. Merring has received excellent reviews from the disputing parties he has served as a mediator. Parties have consistently given him excellent Performance Ratings in each category, dipping slightly when the case did not settle. Even in those cases, the disputing parties would recommend his services and have shown a willingness to use him again. Disputants have appreciated his ability to effectively draw people together, provide useful evaluations, and offer his services at competitive rates. Mr. Merring has received particularly high marks for his level of preparation and organization leading up to a claim. Disputants have recognized how he saves time and wasted energy by studying the case materials before mediation proceeds, providing him with a solid understanding of the facts before the parties arrive. Disputing parties have also noted Mr. Merring’s diligence in following up on cases—providing examples where he continued working with both sides for weeks after the original meeting in order to secure a settlement. According to his feedbacks, Mr. Merring is considered to be an effective mediator who is a strong negotiation facilitator. He is described as a sympathetic listener who is open to inquiries and yet can be evaluative if the parties call for an honest assessment of their position. Parties stated that he arrives at the mediation prepared and he refused to give up, even if the negotiation requires several additional weeks to settle. Mr. Merring runs his practice out of his home in Costa Mesa, which provides a unique space for conflict resolution. Disputing parties did not uniformly agree that it is the ideal place for business mediation, but emphasized that his process and affordability increase the likelihood they would use him again. No reportable negative comments have arisen in the past two calendar years.
