Laurie REVIEWER: AAA/ICDR STAFF imireviewer@adr.org Last Update: Friday 25th June 2010 This Feedback Digest is based on 5 Feedbacks in 8 Mediations as of June 25, 2010. Parties and counsel who have used Ty Laurie would overwhelmingly use his services again and would, without hesitation, recommend him to others. Typical of the comments reflecting Mr. Laurie’s acceptability are: (i) For a major construction dispute, Mr. Laurie would be at the top of the list due to his expertise, reputation, respect, ability and tenacity in working to get a deal done; (ii) Mr. Laurie has an assertive style that gets to the heart of a dispute quickly so that true settlement discussions can be conducted. He also keeps the parties on task at all times and makes them stay engaged in the process; (iii) I have mediated well over 100 cases with different mediators, and Ty is exceptional. He was able to resolve four complicated cases, each of which I thought could not be settled; (iv) I have recommended Mr. Laurie to others as a mediator, especially for cases that are complex, with damages in the eight figures; (v) Mr. Laurie is an excellent mediator. I have participated in mediations across the country on large projects with some of the “premium” mediators and in many of those cases I would have preferred Mr. Laurie; and (vi) Mr. Laurie was professional and effective and I have recommended him many times since our first mediation ended. As a facilitative mediator, he is one of, if not the best I have used in a 35 year construction litigation career. Mr. Laurie’s mediation skills and abilities are rated as highly effective. Typical of feedback received in this regard are: (i) Mr. Laurie effectively exposed both sides’ weaknesses, which enabled the parties and their representatives to begin to focus on getting a deal done and not continuing to advocate the strengths of their respective cases. His knowledge of the field coupled with his blunt and persuasive communication also made a decisive difference in the outcome; (ii) Mr. Laurie has a no-nonsense, practical approach to getting to the heart of a dispute and forcing everyone to stay on task; (iii) Mr. Laurie’s process is highly interactive and effective, but demands a high level of skill, command, knowledge, and intelligence. He possesses and delivers all the attributes necessary for a successful mediation. His ability to manage discussions in joint sessions to clarify issues and positions accelerated negotiations and allowed the parties to make a business decision; (iv) Mr. Laurie was willing to understand the complex and numerous technical issues. He reviewed the documents and worked the parties hard to understand the claim and damages so a settlement was possible. He also had the ability to understand complex design and construction issues on a large project; and (v) He has the intelligence to see “hot button” issues quickly and clearly, and the patience to deal with some very difficult personalities. Mr. Laurie is also highly regarded for his ability to effect a positive outcome. For example, one provider of feedback noted that Ty took real ownership in bringing this matter to resolution. Despite the parties reaching an impasse at the end of several sessions, he continued to work with both sides during the formal sessions and through follow up phone calls. I am convinced that a deal could not have been reached without his involvement. Costs were widely reported as reasonable in the context of the value of the disputes mediated by Mr. Laurie, and in general a very high degree of satisfaction was reported. No reportable negative comments have been received since Mr. Laurie’s designation as an IMI Certified Mediator.
